These Terms of Service govern your access to and use of thethirdgentleman.com, purchases from The Third Gentleman, and related services, consultations, communications, and tools. By using the site, placing an order, submitting an inquiry, or communicating with us, you agree to these Terms.

About The Third Gentleman

The Third Gentleman offers menswear, ready-to-wear products, made-to-measure services, custom/private-commission inquiries, consultation-based styling, and related products or services. Product availability, services, pricing, and timelines may change.

Eligibility and Customer Responsibility

You agree to provide accurate information when placing orders, submitting forms, requesting consultations, or communicating with us. You are responsible for reviewing order details, sizing, measurements, addresses, contact information, product-page fit notes, supplier-direct notices, and approvals before submitting them.

Product Information and Images

We work to present products, swatches, colors, materials, measurements, and descriptions accurately. However, colors, fabrics, textures, proportions, and finishes may vary due to photography, lighting, screen settings, dye lots, supplier changes, and manufacturing tolerances. Digital swatches and images are guides, not guarantees.

Pricing, Availability, and Errors

Prices, promotions, availability, and product details may change without notice. We reserve the right to correct errors, cancel or refuse orders, update pricing, or adjust availability if information is inaccurate, incomplete, or affected by supplier/technical issues.

Order Acceptance

An order confirmation or inquiry confirmation does not mean an order has been accepted for fulfillment or production. We may review orders for availability, payment, fraud prevention, address accuracy, supplier status, customization requirements, or other operational reasons. We reserve the right to refuse or cancel orders where appropriate.

Ready-to-Wear Purchases

Ready-to-wear items are governed by the product page, checkout terms, Shipping Policy, and Return & Refund Policy. Customers are responsible for reviewing sizing, product details, shipping information, product-page fit/cut notices, and return eligibility before purchasing. Supplier-direct, tailored-cut, final-sale, special-order, or no-exchange items may not be eligible for size-selection exchanges or returns once shipped.

Made-to-Measure, Custom, and Private Commissions

Made-to-measure (MTM), custom, special-order, and private-commission garments require additional review and approval. Submitting a profile packet, measurements, preferences, swatch selections, reference photos, or consultation notes does not create a production order, reserve fabric, guarantee pricing, or begin manufacturing.

Production begins only after The Third Gentleman confirms garment details, pricing, timeline, payment requirements, and approval steps with you. Deposits and payments may become non-refundable once consultation work, design preparation, fabric sourcing, supplier coordination, pattern/pre-production work, or production prep begins.

MTM/custom fit concerns are reviewed case by case. Remedies may include alteration guidance, alteration support, remake support, store credit, or another solution at our discretion depending on the circumstances. We do not guarantee refunds or automatic remakes for subjective fit preferences, inaccurate customer-provided measurements, weight/body changes, missed appointments, or changes requested after approval.

Women’s Suiting and Private Consultation

Women’s suiting inquiries may be considered by private consultation. Availability depends on garment type, fit needs, fabric, supplier capability, timeline, and whether the project is appropriate for The Third Gentleman’s current offering. Submitting an inquiry does not guarantee acceptance of the commission.

Payments

Payment must be authorized and accepted before fulfillment or production. We may use third-party payment processors. By submitting payment information, you represent that you are authorized to use the selected payment method.

Shipping, Returns, and Refunds

Shipping, returns, refunds, exchanges, final-sale items, restocking fees, and international order terms are governed by our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms.

Consultations and Communications

Consultations, recommendations, styling guidance, fit guidance, and profile-builder outputs are advisory unless confirmed in a final written order approval. We may communicate by email, phone, SMS, or other channels you provide, subject to applicable consent and privacy rules.

Intellectual Property

The site, brand name, copy, graphics, product presentation, images, designs, software, and other content are owned by or licensed to The Third Gentleman or its partners and may not be copied, reproduced, resold, scraped, or used for commercial purposes without permission.

Prohibited Uses

You may not use the site or services for unlawful activity, fraud, abuse, unauthorized access, scraping, interference with site functionality, infringement, harassment, or any activity that harms The Third Gentleman, customers, partners, or the site.

Third-Party Services

Our store may use third-party services such as Shopify, payment processors, email/SMS platforms, analytics tools, advertising platforms, shipping carriers, and fulfillment partners. Those third parties may have their own terms and privacy practices.

Limitation of Liability

To the fullest extent allowed by law, The Third Gentleman is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, supplier delays, carrier delays, technical errors, or issues outside our reasonable control. Our total liability for a claim related to a purchase will not exceed the amount paid for the item or service giving rise to the claim, unless otherwise required by law.

Indemnification

You agree to indemnify and hold The Third Gentleman harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of the site, violation of these Terms, violation of law, or infringement of third-party rights.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where consumer protection law requires otherwise.

Changes to These Terms

We may update these Terms by posting a revised version on this page. The Terms in effect at the time of purchase apply to that purchase.

Product-Page Acknowledgments

Some products may require a size, fit, final-sale, supplier-direct, or other purchase acknowledgment before adding the item to cart. By checking that acknowledgment or completing checkout, you confirm that you reviewed the relevant product-page notice. These acknowledgments do not limit your rights if The Third Gentleman sends the wrong item or if the item arrives damaged.
